englischThe book examines recent developments in the European social dialogue involving umbrella organizations of employers and trade unions. The results of this dialogue increasingly take the form of implementation-oriented albeit legally non-binding texts. However, theoretical approaches and empirical evidence of underlying implementation processes as well as of related problems and effects are scarce. The book addresses this shortcoming and provides both an analytical framework and empirical evidence of a case study of two sectoral social dialogues. By analyzing the interlinkages of the supranational and national levels, the book pays particular attention to the national members of the European umbrella organizations. The book explores the regulatory potential of social dialogue via legally non-binding texts and contributes to theory building on forms of soft regulation within the EU.
Die Autorin widmet sich einer neueren Entwicklung im Sozialdialog auf EU-Ebene, an dem Dachverbände von Gewerkschaften und Arbeitgebern beteiligt sind. Hier werden in jüngerer Zeit implementationsorientierte, jedoch rechtlich unverbindliche Ergebnisse erzielt. Weitgehend unklar ist, wie eine Implementation dieser Sozialdialogsergebnisse stattfindet. Die Studie nimmt sich dieser black box in explorativer Weise an und präsentiert sowohl einen Analyserahmen als auch Empirie, deren Schwerpunkt auf zwei Sektordialogen liegt. Dabei zieht sie, als eine von wenigen Forschungsarbeiten bislang, nationale Verbände umfassend in die Untersuchung mit ein und schließt so ein Stück weit die Forschungslücke hinsichtlich Verknüpfung von supranationaler und nationaler Ebene und Auswirkungen auf mitgliedstaatlicher Ebene. Die Studie erlaubt erste Aussagen zur Regulierungsfunktion des Sozialdialogs durch rechtlich unverbindliche Ergebnisse und trägt zur Theoriebildung zu weichen EU-Regulierungsformen bei.
