englischIn order to prevent negative effects of privatisations, public authorities often impose specific obligations on their private contractual partners, e.g. social and ecological duties. However, this approach limits the attraction of a bargain. It can thus reduce the proceeds and favour the contracting undertaking within the meaning of Art. 107 section 1 TFEU. This thesis analyses the requirements of EU State aid law with regard to such secondary purposes in the context of privatisations. It addresses the question whether these specific duties can be classified as SGEI or be priced into the return of a privatisation. The text also offers suggestions for a further development of the relevant EU State aid law practice.
