englischA glance at legal traditions in Common Law reveals that representation by a lawyer in civil proceedings, particularly a mandatory requirement to be represented as it is common in Civil Law, is not self-explanatory. The possibility of representing oneself in court is regarded as a basic right in Common Law and is frequently exercised in practice. This thesis examines the right to self-representation from a comparative law perspective with a focus on U.S. and English law. Since the absence of lawyers poses a challenge for access to justice and the efficiency of the judiciary, suggestions for the legislator for improving the position of self-represented parties are presented, also based on the German example.
