englischThis thesis focuses on social networks as part of an inheritance, a problem known as digital legacy. Unlike previous publications on this subject, it focuses on the dogmatics of the postmortem protection of secrecy, which has received very little consideration so far. Before answering this substantial question, it addresses the issue of the hereditability of continuing obligations. Its central chapter on the postmortem protection of secrecy first clarifies the basics of the protection of secrecy while an individual is alive with its manifestations of the secrecy of telecommunications and data protection. After that, the thesis clarifies how the legal situation changes postmortem and what dogmatics are behind that change. The book closes with a chapter on the regulations on inheritance in the terms and conditions of the providers of social networks.
Die Arbeit befasst sich mit sozialen Netzwerken im Nachlass und damit mit dem Problem, das als digitaler Nachlass bekannt ist. Anders als bisherige Veröffentlichungen zum Thema stellt das Werk die Dogmatik des postmortalen Geheimnisschutzes in den Mittelpunkt, die in der Diskussion kaum Beachtung gefunden hat. Bevor diese große Frage geklärt wird, wird das Problem der Vererbbarkeit von Dauerschuldverhältnissen diskutiert. Das zentrale Kapitel zum postmortale Geheimnisschutz klärt zunächst die Grundlagen des Geheimnisschutzes zu Lebzeiten mit seinen Ausprägungen Fernmeldegeheimnis und Datenschutz. Im Anschluss wird geklärt, wie sich die Rechtslage postmortal ändert und welche Dogmatik dahintersteht. Die Arbeit schließt mit einem Kapitel zu den Regelungen zum Nachlass in den AGB der Anbieter sozialer Netzwerke.
