englischThe good price remains good, the bad one remains bad. The research paper investigates in how far this guiding principle is still true. The Federal Court restricted it with its jurisdiction concerning unethical unit prices. The author works out the dogmatic basis of this jurisdiction and evaluates its suitability to prevent speculations on quantities. Furthermore, he examines how the reform of the building contract law affects the pricing according to the Construciton Contract Procedures Part B. Another focus is put on the development of practice-oriented proposed solutions, which prevent speculative behaviour patterns with the help of a new remuneration model or which face them in case of a continued validity of the previous pricing.
