englischPublic partnerships are a ubiquitous phenomenon, connected with the hope of increasing efficiency, effectiveness and acceptance of State actions. Nevertheless, the democratic order typically does not depend on the model of State cooperation, but on authoritarian decisions. Against this background, the work describes the development of cooperation as a form of State action, the actors in this field, the legal practice and legal frameworks and presents results capable of generalization.
Staatliche Kooperationen sind ein ubiquitäres Phänomen, mit dem die Hoffnung auf Steigerung von Effizienz, Effektivität und Akzeptanz des Handelns verbunden sind. Trotzdem ist die überkommene staatliche Legitimationsordnung nicht am Leitbild des kooperierenden Staates ausgerichtet, sondern an jenem des hoheitlich entscheidenden. Vor diesem Hintergrund beschreibt das vorliegende Werk die Entwicklung der Kooperation als staatliche Handlungsform, die Akteure, die Rechtspraxis und Rechtswissenschaft und bietet verallgemeinerungsfähige Ergebnisse.
