englischThe investigation is concerned with the question of whether and to what extent an effective protection of data and personality of individuals can be demanded from and ensured by the state on the basis of the right to general personal privacy in an increasingly interconnected and digitalised worlds. This question is investigated using the example of modern transport information technology. In exploring the possibility of a governmental obligation to protect, the right to the confidentiality and integrity of information technological systems in case of the examples of the networked vehicle and intelligent transport systems in a national and European context are used in particular. The author extensively evaluates the jurisprudence of the German Constitutional Court and of European courts and investigates the recent EU General Data Protection Regulation.
