englischJudges, prosecutors and police officers tasked with criminal prosecution are given special powers authorising them to infringe upon constitutional rights and interests usually protected by criminal laws, e.g. to make arrests or to conduct surveillance. Reversely, abusing such powers is considered a gross injustice. It is between these poles that this book systematically examines the distinct conditions and limits of officials’ criminal liability for unlawful conduct. In doing so, it provides an essential piece that has so far been missing in a general doctrine of legal errors and their consequences concerning procedural errors in criminal proceedings. The work focuses on crimes against the administration of justice and against individual rights, particularities regarding the general limits of culpability, and specific limits pertaining to the offender’s position. The arising issues are solved based on the premise of criminal law’s comprehensive accessoriness to procedural law.
