englischThe book examines the conflict situations at international level arising from the spread of criminal sanctions in national competition law and thereby in particular deals with the risks linked to criminal law provisions of several countries being applicable to one and the same international cartel. Before analyzing these conflicts, the author examines to what extent treaties and instruments of international cooperation and coordination, both from the sphere of criminal law and the sphere of competition law, apply to the enforcement of national criminal competition law provisions.
In this context, the author in particular analyzes the applicability of EU Regulation 1/2003 to prosecutors of the EU Member States and under what conditions a national criminal law provision should qualify as “national competition law” within the meaning of the said Regulation.
Die Arbeit untersucht das mit der Verbreitung strafrechtlicher Sanktionen für Kartellrechtsverstöße verbundene Konfliktpotenzial auf internationaler Ebene und beleuchtet dabei insbesondere die Gefahren, die sich aus dem parallelen Eingreifen mehrerer nationaler Kartellstrafregime auf einen internationalen Kartellverstoß ergeben. Dabei werden vorgelagert die auf strafrechtlicher und auf kartellrechtlicher Seite bestehenden internationalen Kooperations- und Koordinierungsmechanismen auf ihre Verfügbarkeit bei der Durchsetzung nationaler Kartellstraftatbestände hin untersucht.
In diesem Zusammenhang wird unter anderem ein umfassendes Lösungsmodell dazu entwickelt, inwieweit die Staatsanwaltschaften der EU-Mitgliedsstaaten den Instrumenten der europäischen Kartellverfahrensverordnung (Verordnung 1/2003) unterliegen und wann ein nationaler Straftatbestand als „einzelstaatliches Wettbewerbsrecht“ im Sinne dieser Verordnung anzusehen ist.
