englischThe dissertation deals with the topic of criminal offences and criminal prosecution on the Darknet. What exactly is the Darknet and what is the technical infrastructure behind it? Does it open up new fields of activity for cybercriminals, to which it is necessary to react on a legislative level? Which criminal offences are typically committed there? And above all: how are criminal investigations on the Darknet carried out? This thesis provides answers to the questions raised above. In the end, it points out that that the Darknet is neither a "lawless" nor a "prosecution-free" communication space.
Die Dissertationsschrift setzt sich mit dem Thema Straftaten und Strafverfolgung im Darknet auseinander. Was genau ist eigentlich das Darknet und welche technische Infrastruktur steht dahinter? Eröffnet es neuartige Betätigungsfelder für Cyberkriminelle, auf die es auf legislatorischer Ebene zu reagieren gilt? Welche Straftatbestände werden dort typischerweise verwirklicht? Und wie wird dort ermittelt? Die vorliegende Arbeit gibt Antworten auf die aufgeworfenen Fragestellungen und wird für die Praxis von erheblicher Bedeutung sein. Im Ergebnis wird in der Arbeit resümiert, dass das Darknet weder einen „rechtsfreien“ noch einen „strafverfolgungsfreien“ Raum darstellt.
