englischSince it is able to secure important services, to minimize environmental and health risks and to promote innovation, workplaces and economic growth the substitution of environmentally hazardous substances by safer alternatives holds great potential for a sustainable development of the chemical industry.
Therefore the aim of a legal promotion of substitution has recently entered the chemical legislation such as the REACh Regulation.
Because of the potential but especially the complexity of such a legal promotion the author analyses existing approaches within the chemical, pesticide and biocide regulations in terms of their effectiveness and their proportionality.
Die Ersetzung umweltgefährdender Stoffe durch umweltfreundlichere Alternativen birgt großes Potential zur Verwirklichung einer nachhaltigen Entwicklung der chemischen Industrie, da hierdurch wichtige Stoffdienstleistungen gesichert, Umwelt- und Gesundheitsrisiken minimiert und zudem Innovationsvorsprünge, Arbeitsplätze und gesellschaftlicher Wohlstand gefördert werden können. Angesichts dessen hat das Anliegen der Substitutionsförderung bereits vor einigen Jahren Eingang in die Vorschriften des kausalen Gefahrstoffrechts u.a. in Form der im Jahr 2007 in Kraft getretenen REACH-Verordnung gefunden.
Aufgrund des Potentials aber insbesondere auch der Komplexität einer rechtlichen Substitutionsförderung widmet sich die Autorin der Analyse bestehender Förderansätze innerhalb der Vorschriften des allgemeinen Chemikalienrechts, Pflanzenschutz- und Biozidrechts hinsichtlich ihrer Effektivität sowie ihrer Verhältnismäßigkeit im Spannungsfeld zwischen umweltrechtlichen Schutzpflichten und Wirtschaftsgrundrechten.
