englischThe present study deals with the structures of biomass fuel law in force within the European Union, Germany and Brazil. Following a description of the biomass fuels sector and the phenomenology of biomass fuels, the fundamental structures of EU biomass fuel law are analysed, taking into account the modifications driven by the directive (EU) 2015/1513 in consideration of indirect land-use change (iLUC). A matter of particular importance and observance are the sustainability criteria, understood as the ecological centerpiece of European regulation on biomass fuels and its transformation into German biomass fuel law. This is followed by a reappraisal and comparative analysis of Brazilian biomass fuel regulation including the answer to the final (key) question of whether the structures and instruments of Brazilian law provide a framework for the integration of sustainability criteria according to the European role model.
Die vorliegende Untersuchung befasst sich mit den Strukturen des Biokraftstoffrechts der EU, Deutschlands und Brasiliens. Nach Darstellung des Realbereichs und der Phänomenologie der Biokraftstoffe werden die wesentlichen Strukturen des Biokraftstoffrechts der EU unter Einbeziehung der mit RL (EU) 2015/1513 vorgenommenen Modifikationen der EE-RL in Bezug auf die Berücksichtigung von indirekten Landnutzungsänderungen (iLUC) analysiert. Besonderer Beachtung unterliegen die Nachhaltigkeitskriterien als ökologisches Herzstück der europarechtlichen Biokraftstoffregulierung sowie deren Transformation in das deutsche Biokraftstoffrecht, vornehmlich dem BImSchG und der Biokraft-NachV. Sodann folgt eine Aufarbeitung und rechtsvergleichende Betrachtung der brasilianischen Biokraftstoffregulierung mit der Beantwortung der abschließenden Frage, ob die Strukturen des brasilianischen Rechts Ansatzpunkte für eine Integration von Nachhaltigkeitskriterien nach europarechtlichem Vorbild bieten.
