englischIn many cases, an effective use of wage structure agreements can already solve the increasing conflict arising from modern corporate structures and corporate co-determination. Forming a works council, it is therefore crucial to take account of the special aspects of modern organizations based on the German works constitution law. This analysis of the options given in § 3 BetrVG regarding modern corporate structures shows a multitude of practical measures for the respective forms of organizations. However, the analysis also shows that a clear reform of § 3 BetrVG remains to be demanded and what form it has to take to create a norm that is sufficient and future-oriented for all modern structures.
