englischThe number of employees covered by a collective agreement in Germany is steadily diminishing. A major reason for this development is the increasing reluctance of employers to participate in collective bargaining and the decreasing coverage of employers' associations . Initially, the book examines the main factors in the legal system responsible for this development in order to develop concepts to stabilise the system, inter alia in reference to other jurisdictions. It is aimed at both academics and practitioners in the field of collective bargaining law. Prof. Dr. Olaf Deinert is Dean of Studies at the Law Faculty, University of Göttingen, and author of numerous publications on Labour and Employment Law. Dr. Manfred Walser is research assisstant at the Chair for German and International Labour, Employment and Comparative Law, University of Hamburg.
Die Zahl der von einem Tarifvertrag erfassten Arbeitnehmer nimmt in Deutschland beständig ab. Ein wesentlicher Grund hierfür stellt die sinkende Bereitschaft von Arbeitgebern zur Teilnahme am Tarifsystem und der abnehmende Organisationsgrad von Arbeitgeberverbänden dar.
Das Buch nimmt zunächst eine Bestandsaufnahme der Faktoren in der Rechtsordnung für diese Entwicklung vor, um daraus u.a. durch einen Vergleich mit anderen Rechtsordnungen juristische und rechtspolitische Konzepten zur Stabilisierung der Arbeitgeberbindung im Tarifsystem zu entwickeln. Es richtet sich sowohl an Wissenschaftler wie auch Praktiker im Bereich des Tarifrechts.
Prof. Dr. Olaf Deinert ist Studiendekan der Juristischen Fakultät der Georg-August-Universität Göttingen und Autor zahlreicher Publikationen zum Arbeits- und Sozialrecht, Dr. Manfred Walser ist wissenschaftlicher Mitarbeiter am Lehrstuhl für Deutsches und Internationales Arbeits- und Sozialrecht und Rechtsvergleichung der Universität Hamburg.
