englischAccording to latest estimates, approximately 6.85 million German citizens are no longer able to pay both their cost of living and their due liabilities. Thus the number of overindebted private individuals has reached a historical high. Taking this into account, the study examines the current legislation on private bankruptcy and discharge of residual debt, which was introduced in 1999. The legal rules were established to offer a new start to overindebted individuals. This thesis analyses if the objectives set by the legislative have been attained. Furthermore it examines reasons why the objectives have been partially reached at best. In this respect, the thesis contributes to impact research on legislation.

Within this research issue, the thesis comprehensively deals with the phenomenon of overindebtedness and its social framework and causes.
