englischThe implementation of living wills continues to encounter uncertainties, which are examined in the context of this thesis. In addition to the question of the extent to which the participation of a patient representative is necessary for the implementation of an advance directive, it is also clarified whether the binding effect of an advance directive also exists if the natural will of the dementia patient who is incapable of consent appears to contradict the directive. The consequences under civil and criminal law of disregarding the patient's anticipated will are also dealt with. The aim of the work is to create greater legal certainty by which the tension between the protection of life and the patient's right to self-determination is to be resolved.
