englischThe thesis answers under which conditions film excerpts of a pre-existing work or motion picture may be used for video-based user-generated content (UGC) such as fan films without the consent of the rights holder and undertakes a legal classification in European, German and U.S. copyright law. The significance of the work lies above all in the fact that it sharpens the view on concrete problems of the assessment of UGC and examines to what extent criteria of the fair use analysis can be profitable for German law. Practice-relevant peculiarities of film law are elaborated. The author works as legal counsel in a film production company.
Die Arbeit beantwortet unter welchen Voraussetzungen Filmausschnitte eines vorbestehenden Werkes oder Laufbildes ohne Einwilligung der Rechteinhaber für videobasierten User Generated Content (UGC) wie Fan Filme benutzt werden dürfen und nimmt eine rechtliche Einordnung im europäischen, deutschen und U.S.-amerikanischen Urheberrecht vor. Die Bedeutung der Arbeit liegt vor allem darin, dass sie den Blick auf konkrete Probleme der Beurteilung von UGC schärft und untersucht, inwieweit Kriterien der Fair Use-Prüfung für das deutsche Recht gewinnbringend sein können. Es werden praxisrelevante Besonderheiten des Filmrechts herausgearbeitet. Die Verfasserin ist als Legal Counsel in einem Filmproduktionsunternehmen tätig.
