The work deals with the complicated interaction of European and national standards, highlights problems and ambiguities, suggests solutions, analyses the most prominent practical examples and thus offers preliminary considerations for further legal developments. Essential aspects of the work are the identification of eligible liabilities, the determination of the conversion rate and, in this context, the valuation of liabilities, as well as the analysis of existing legal protection.
Das Bail-In-Instrument ist zentraler Bestandteil des Instrumentariums zur Sanierung und Abwicklung von Kreditinstituten und zielt darauf ab, dass Eigen- und Fremdkapitalgeber eines Kreditinstituts einen Sanierungsbeitrag leisten.
