englischThe thesis examines how the right to a fair trial can be guaranteed in transnational internal investigations. It focusses on those investigations conducted by German companies that examine alleged violations of the US Foreign Corrupt Practices Act. The thesis therefore provides an analysis of the admissibility of transnational internal investigations according to public international law, as well as of their impact on the defendant’s rights. Based on the principles of a fair criminal trial, the thesis aims to elaborate conditions for a “fair” transfer of information in transnational internal investigations and to examine if and to what extent German prosecution authorities are allowed to use these discoveries.
