englischGerman football league clubs want to prevent the resale of their tickets on the unauthorised secondary market for various reasons. With regard to the comparatively low ticket prices and the frequently existing excess demand, considerable profits can be achieved at resale of the tickets.

At the legal level, clubs try to put a stop to the unauthorized secondary market business by implementing resale restrictions in their General Ticket Terms and Conditions. In the field of contract law, this doctoral thesis answers the question to what extent such clauses constitute a suitable instrument for the German football league teams to ensure the intended control of their ticket distribution. In the course of a comprehensive review of those General Terms and Conditions, the author examines how the tension between the interests of the various parties involved is resolved within the scope of a review of the content according to §§ 307 ff. of the German Civil Code (BGB).
