englischThe volume documents the lectures given on the occasion of Würzburg’s 21st Days of European Law on the “Administrative Jurisdiction of the European Union”. The topic has been discussed intensively in academic circles for about 20 years. The main issue of the debate used to be the influence of Community Law on substantive administrative law and national procedural law. Over the last few years, though, the European Convention on Human Rights was discovered as an additional source of law. Primary motors of development are the European Court of Justice and the European Court of Human Rights. Yet, national administrative jurisdiction forms a crucial part of the practical enforcement of European Administrative Law due to the fact that it is executed by national authorities. Goal of the conference was to pursue different dimensions of the Europeanisation in the interplay of European and national administrative courts.

Der Band dokumentiert die Vorträge, die anlässlich der 21. Würzburger Europarechtstage zur „Verwaltungsgerichtsbarkeit in der Europäischen Union“ gehalten wurden. Das Thema wird in der Prozessrechtswissenschaft seit rund 20 Jahren intensiv diskutiert. Im Vordergrund der Debatte standen zunächst die Einwirkungen des Gemeinschaftsrechts auf das materielle Verwaltungsrecht und das nationale Verwaltungsprozessrecht. In den vergangenen Jahren wurde aber auch die Europäische Menschenrechtskonvention als Rechtsquelle entdeckt. Motoren der Entwicklung sind primär der Europäische Gerichtshof und der Europäische Gerichtshof für Menschenrechte. Die nationale Verwaltungsgerichtsbarkeit hat jedoch ebenso entscheidenden Anteil an der praktischen Durchsetzung des europäischen Verwaltungsrechts, da es durch nationale Behörden vollzogen wird. Ziel der Tagung war es, den verschiedenen Dimensionen der Europäisierung im Zusammenspiel von europäischen und nationalen Verwaltungsgerichten nachzugehen.
