Therefore, the question may be raised whether the German Copyright Law nevertheless provides protection from the risk of confusion. Provided that there are parallels, this may help with the interpretation of copyright regulations and lead to a reconsideration of the principles concerning the risk of confusion in Trade Mark Law and the risk of confusion in the Law Against Unfair Competition.
Während die Verwechslungsgefahr im spanischen Urheberrecht normiert und in der französischen Rechtsprechung zur Beurteilung urheberrechtlicher Konstellationen anerkannt ist, wird der Begriff in Deutschland nicht im Urheber-, sondern im Marken- und Wettbewerbsrecht verwendet. Es fragt sich, ob das Urheberrecht gleichwohl vor Verwechslungsgefahr schützt. Bei entsprechenden Parallelen könnten nicht nur urheberrechtliche Begriffe schärfer konturiert werden, sondern auch die Grundsätze zur Beurteilung der Verwechslungsgefahr im Marken- und Wettbewerbsrecht überdacht werden.
