englischIn contrast to the Spanish Copyright Law and the relevant case-law of French courts relating to copyright infringements, the term ‘likelihood of confusion’ is not used in German Copyright Law but in Trade Mark Law and the Law Against Unfair Competition. Therefore, the question may be raised whether the German Copyright Law nevertheless provides protection from the risk of confusion. Provided that there are parallels, this may help with the interpretation of copyright regulations and lead to a reconsideration of the principles concerning the risk of confusion in Trade Mark Law and the risk of confusion in the Law Against Unfair Competition.
