englischThis work attempts to provide a solid answer to the main question of the theoretical meaning and practical role of the principle of European solidarity in the context of the general provisions of European Law and the economic crisis, and in particular of the ESM, both in times of continuous economic growth as well as crisis period. Methodological instrument sets the interpretation of the member-state solidarity in all past and present European Law written regulations. Throughout the analysis of the various manifestations of European solidarity, this book determines its normativity, justiciability and addressees, as well as its relationship to the principles of subsidiarity and sovereignty. The end result is the confirmation of the multi-dimensionality of solidarity and its function as a constitutional principle, objective and value of the EU.
Diese Arbeit versucht, im Rahmen der allgemeinen Vorschriften des europäischen Rechts sowie der Wirtschaftskrise bewältigenden Maßnahmen und insbesondere des ESM auf die Hauptfrage der theoretischen Bedeutung und der praktischen Rolle des europäischen, mitgliedsstaatlichen Solidaritätsprinzips sowohl in Zeiten ständigen ökonomischen Wachstums als auch in Krisenperioden eine solide Antwort zu geben. Als Methodologisches Instrument stellt die Interpretation der mitgliedsstaatlichen Solidarität in allen den vergangenen sowie heutigen Vorschriften des europäischen Rechts dar. In der Analyse der verschiedenen Erscheinungsformen der europäischen Solidarität werden, ihre Normativität, Justiziabilität und ihre Adressaten sowie ihr Verhältnis zu dem Subsidiaritäts- und zum Souveränitätsprinzip bestimmt. Als Endergebnis ist die Mehrdimensionalität der Solidarität und ihre Funktion als Verfassungsgrundsatz, Zielsetzung und Wert der EU bestätigt.
