englischThe work examines the emergence of the principle prohibiting the abuse of law in the legal systems of the European countries. It analyzes whether such a general principle exists in the law of the Civil and Common Law countries and what similarities the different rules have. Subsequently, it summarizes and evaluates the case law of the ECJ and the EFTA Court on this issue. Based on this analysis the prohibiting of abuse of law and its elements on EU and EEA-level are defined. Finally, common European law and European law are compared.

The focus of the work is the economic and social function of the prohibition of abuse of law in common European law and European law.
