englischThe dissertation undertakes the first comprehensive examination of the influence of video game publishers on esports and its legal limitations. The fact that video games are in the hands of publishers in terms of software and intellectual property rights affects the interests of esports as a competitive culture. Among other things, contract, tort and antitrust law limit the resulting influence. However, this protection is neither sufficient to ensure sustainable development, nor is esports able to defend itself through self-regulation. Finally, the conclusion is that if the government wants to promote esports, they have to protect them from publishers in certain aspects.
