englischNot least because of the widespread shortage of skilled workers, employers are increasingly seeking to actively protect their workforce and limit wage increases associated with labour shortages. Examples from practice, particularly from the United States of America, show that employers coordinate anti-competitively, for example through means of no-poaching agreements, and thus deprive employees of career prospects and opportunities for personal development.

The author examines the extent to which German and European private and competition law sanction such employer behaviour. He also furthers the dogmatics of duties to protect derived from fundamental rights.
