englischLobbying is a constituent component of the EU’s political system. Every day more than 20,000 lobbyists try to influence the decision-making processes of EU institutions. Until the Treaty of Lisbon, political interest representation was a purely factual phenomenon. With the introduction of Art. 11 of the TEU, it has become an instrument of European constitutional law. This study presents and assesses the theoretically democratic ‘upgrading’ of lobbying the European Union. Using the European legislation process as an example, the author reconstructs the democratic legitimation model with a particular focus on the aforementioned new participatory approach.
Politische Interessenvertretung zivilgesellschaftlicher Akteure ist ein fester Bestandteil des politischen Systems der Europäischen Union. Täglich versuchen 20.000 Lobbyisten den politischen Entscheidungsfindungsprozess der Unionsorgane zu beeinflussen. Bis zur Vertragsreform von Lissabon stellte dies ein rein faktisches Phänomen der Verfassungswirklichkeit dar. Mit Aufnahme von Art. 11 EUV hat politische Interessenvertretung nunmehr Eingang in das europäische Verfassungsrecht gefunden: Das demokratische Legitimationsmodell europäischer Hoheitsgewalt wurde – auch in Reaktion auf das konstatierte „Demokratiedefizit“ – um ein partizipatives Element ergänzt. Die demokratietheoretische Aufwertung zivilgesellschaftlicher Partizipation erfährt in dieser Untersuchung eine nähere Darstellung und Bewertung. Am Beispiel der europäischen Gesetzgebung rekonstruiert der Autor das dem europäischen Verfassungsrecht zugrunde liegende Legitimationsmodell unter Einbeziehung von Art. 11 EUV.
