englischLegal theory is often described as an analytical sub-discipline of legal philosophy. Its recent development, however, has moved away from this historically founded description. The aim of legal theory thus asks for a new definition. Drawing on a multitude of methods and insights taken from the humanities as well as the social and natural sciences, Marietta Auer argues that contemporary legal theory should be understood as the pivotal source of multidisciplinary innovation in legal scholarship. Contemporary legal theory reaches far beyond the boundaries of analytical philosophy of law. Yet, it remains dependent on its philosophical foundations. It can therefore be redefined as a philosophical theory of multidisciplinary legal scholarship. Marietta Auer lectures in private law and philosophy of law at the University of Giessen. Her research focuses on the history of ideas of private law, interdisciplinary theory of law as well as European and comparative private law.
