englischPress wholesalers (Presse-Grosso) play a special role in the Press distribution system in Germany to ensure the protection of the freedom of the press, speech and information by allowing the availability of newspapers and magazines at fixed prices. This work deals with the interplay between cartelization and Constitutional law and focusses on the new regulation under § 30 para. 2a incorporated by the 8th amendment to the GWB to which the price fixation contracts between the publisher and wholesaler and the wholesaler and the retailer is subject to.

 

This work, in addition to the historical classification of the Presse-Grosso system, its present functioning and the requirement of press wholesalers to contract within existing legal frameworks also focuses on the violation of a central negotiating mandate against the ban on cartelization and the possible exemption options.
