englischCriminal law does not adequately reflect current and future interests in the context of euthanasia and restricts the fundamental right to self-determined termination of life in a paternalistic manner. A reform of the criminal law regulations on euthanasia is not only necessary since the Federal Constitutional Court declared the businesslike assistance of suicide according to § 217 a.F. StGB unconstitutional on 26 February 2020. Based on a constitutional and legal-philosophical examination, this paper presents a reform proposal that focuses on the autonomy of the individual and includes the partial decriminalisation of killing on demand according to § 216 StGB.
