englischThe cross-linking of ambulatory and stationary patient supply in hospitals is not only considered from a scientific point of view, but also contains practical implementation proposals for the avoidance of liability risks (e.g. fictitious shareholder liability) for intersectoral ASV teams. Dogmatically, the ASV was classified into the system of existing healthcare sectors, and the corporate law classification of intersectoral ASV teams as GbR and its liability was examined. The special features of the hospital MVZ were comprehensively presented and proposals for the modification of the “GmbH Konzernkontrolle” in favor of patient interests in investorled hospital groups with the participation of hospital MVZ were developed.
Die Vernetzung von ambulanter und stationärer Patientenversorgung in Krankenhäusern wird nicht nur aus wissenschaftlicher Sicht betrachtet, sondern enthält praktische Umsetzungsvorschläge zur Vermeidung von Haftungsrisiken (wie z.B. der Scheingesellschafterhaftung) für intersektorale ASV-Teams. Dogmatisch wurde die ASV in das System bestehenden Gesundheitssektoren eingeordnet, sowie die gesellschaftsrechtliche Einordung von intersektoralen ASV-Teams als GbR untersucht. Zudem wurden die Besonderheiten des Krankenhaus MVZ umfassend dargestellt und Lösungsvorschläge zur Modifikation der GmbH Konzernkontrolle zugunsten von Patienteninteressen in investorengeführten Krankenhausverbänden unter Beteiligung von Krankenhaus-MVZ herausgearbeitet.
