englischThis volume deals with questions of legal recourse in state liability law. It examines the constitutional requirements that can be placed on the allocation of legal remedies. In doing so, it answers legal ques-tions about the interaction of Article 14 (3) of the Basic Law, Article 34 p. 3 of the Basic Law and Section 40 (2) p. 1 of the VwGO on the one hand and their dogmatic classification, also with reference to their historical origins, on the other. For this purpose, a distinction is made between primary and secondary legal protection and the consequences of the currently existing “fragmentation of legal recourse” are discussed. Based on those standards, the study shows that an optional adhesion procedure in administrative proceedings can also be made possible through the allocation of legal remedies.
