englischSo far, the discussion on the GDPR has been conducted on an abstract level and its applicability has hardly been scientifically analysed on the basis of practical examples. This is precisely what the author has set out to do, thereby contributing to the development of a legal doctrine of European data protection law. In doing so, she addresses the important issue of combating doping in national professional sport. In order to combat doping, the National Anti-Doping Agency is dependent on the processing of personal data. The author explains in detail that this processing can be based neither on constitutional legal bases nor on effective consent.
Die Auseinandersetzung mit der Datenschutz-Grundverordnung bewegt sich bislang eher auf einer abstrakten Ebene und wird kaum anhand praktischer Beispiele wissenschaftlich auf ihre Anwendbarkeit hin überprüft. Genau dies hat sich die Autorin zur Aufgabe gemacht und leistet damit einen Beitrag zur Herausbildung einer Dogmatik des europäischen Datenschutzrechts. Sie befasst sich dabei mit dem sportpolitisch bedeutsamen Thema der Dopingbekämpfung im nationalen Profisport. Zur Dopingbekämpfung ist die Nationale Anti Doping Agentur auf die Verarbeitung personenbezogener Daten angewiesen. Die Autorin legt ausführlich dar, dass diese Verarbeitung weder auf verfassungskonforme Rechtsgrundlagen noch auf wirksame Einwilligungen gestützt werden kann.
