englischThis volume analyses the dysfunctionality of the German housing market. Using the example of post-war reconstruction, it shows how creating an appropriate legal framework can lead to a well-functioning housing market.

Based on the qualified rent index, the legal causes for the dysfunctional development of the housing market are presented. This is followed by an analysis of the good of housing and the legal risks. The subsequent comparison of the rights of tenants and landlords shows that landlords can only dispose of their property to a very limited extent. It is shown that large investors have withdrawn from the market for these reasons and that small investors cannot meet the demand.
