englischWith the outbreak of the Sars-CoV-2 epidemic in 2020, the provisions of Section 128a of the Code of Civil Procedure came into focus. Since 2002, this provision has allowed oral hearings to be held by means of video and audio transmission. The author examines whether § 128a ZPO can guarantee oral hearings in the event of an epidemic or whether it needs to be further developed in order to ensure health protection and effective legal protection. She develops possible solutions taking into account the principles of civil procedure. Finally, the author assesses the draft law on the promotion of the use of videoconferencing technology in civil and specialised jurisdiction.
Mit dem Ausbruch der Sars-CoV-2-Epidemie 2020 ist die Vorschrift des § 128a ZPO in den Fokus gerückt. Die Regelung gewährt bereits seit 2002 die Möglichkeit, mündliche Verhandlungen mittels Bild- und Tonübertragung durchzuführen. Die Autorin untersucht, ob § 128a ZPO die mündliche Verhandlung bei epidemischen Ereignissen gewährleisten kann oder ob sie weiterentwickelt werden muss, um den Gesundheitsschutz und einen effektiven Rechtsschutz zu gewährleisten. Sie entwickelt Lösungsansätze unter Berücksichtigung zivilprozessualer Verfahrensgrundsätze. Abschließend würdigt die Autorin den Referentenentwurf eines Gesetzes zur Förderung des Einsatzes von Videokonferenztechnik in der Zivil- und Fachgerichtsbarkeit.
