englischThe transfer of personal data in the secondary market poses a number of challenges: From a data protection perspective, the main question is whether and how data protection legitimacy can be established from the perspective of the buyer without direct contact with the data subject. From the perspective of the law of obligations, questions arise as to the nature of the contract and the consequences of a lack of legitimation under data protection law. Alisa Rank-Haedler examines these issues, taking a comparative approach to the law of obligations and using Italian law as a comparative legal system.
Die Überlassung personenbezogener Daten auf dem Sekundärmarkt ist mit verschiedenen Herausforderungen verbunden: Aus datenschutzrechtlicher Sicht stellt sich insbesondere die Frage, ob und wie die datenschutzrechtliche Legitimation aus Sicht des Erwerbers ohne direkten Kontakt zum Betroffenen hergestellt werden kann. Aus schuldrechtlicher Sicht stellen sich Fragen nach dem Vertragstyp und den Folgen einer fehlenden datenschutzrechtlichen Legitimation. Alisa Rank-Haedler widmet sich diesen Fragen, wobei sie für die schuldrechtliche Untersuchung einen rechtsvergleichenden Ansatz wählt und als Vergleichsrechtsordnung das italienische Recht heranzieht.
