The book contains a brief description of the history, reception and continuation of Roman law, Canon law and Greek law. It explains how the respective civil laws were handed down from antiquity and received in German legal history, and how they are still valid today or have had an impact. All three areas of law belong to the legal tradition of Europe, which can also find its identity as a legal and cultural community in this. The connection between legal history and the state and constitution becomes clear in the work of the still highly controversial political scientist Carl Schmitt, to whose work a contribution is added here as an introduction.

Das Buch enthält je eine kurzgefasste Darstellung zur Geschichte, zur Rezeption und zur Fortgeltung des Römischen, des Kanonischen und des Griechischen Rechts. Es wird erklärt, wie es als jeweiliges Zivilrecht und als Rechts- und Staatsphilosophie aus der Antike überliefert und in der deutschen Rechtsgeschichte rezipiert worden ist, in Grundzügen bis heute fortgilt oder Auswirkungen hat. Alle drei Rechtsgebiete gehören zur Rechtstradition Europas, das auch hierin seine Identität als Rechts- und Kulturgemeinschaft finden kann.
Der Zusammenhang von Rechtsgeschichte mit Staat und Verfassung wird deutlich im Werk des nach wie vor höchst umstrittenen Staatswissenschaftlers Carl Schmitt, zu welchem hier ein Beitrag als Einführung hinzugefügt ist.
