englischWith the entry into force of StaRUG and its core element, the restructuring plan, instruments for the restructuring of companies outside insolvency proceedings have for the first time been standardised by law. Due to this novelty, but also due to a significant change in the regulations as a result of the recommendation of the Legal Committee of the German Bundestag, there is a need for clarification in practice.
Against this background, this volume deals with the sustainable success of a reorganisation and the correct course of a company reorganisation within the framework of the StaRUG. It also answers the question of whether the use of the new reorganisation and restructuring framework leads to excessive liability on the part of company directors.
Mit dem Inkrafttreten des StaRUG und seinem Kernstück, dem Restrukturierungsplan, sind erstmals Instrumente zur Sanierung von Unternehmen außerhalb des Insolvenzverfahrens gesetzlich normiert worden. Aufgrund der Neuartigkeit, aber auch aufgrund einer wesentlichen Änderung der Regelungen durch die Beschlussempfehlung des Rechtsausschusses des Deutschen Bundestages besteht für die Praxis Klärungsbedarf.
Vor diesem Hintergrund widmet sich der vorliegende Band dem nachhaltigen Sanierungserfolg, dem sachgerechten Ablauf einer Unternehmenssanierung im Rahmen des StaRUG. Darüber hinaus wird die Frage beantwortet, ob die Nutzung des neuen Sanierungs- und Restrukturierungsrahmens zu einer ausufernden Haftung der Geschäftsleiter führt.
