englischSovereign information activity with steering effect has recently attracted increasing attention. Besides the question if such activity constitutes a successor of the medieval pillory or a modern controlling instrument, the study examines the question which constitutional requirements must be fulfilled and if it currently is in accordance with constitutional law. The draft law amending § 40 LFGB which has been introduced in December 2014 and the discussions about reforming the so called “Pflege-TÜV” show how uncertain this subject area and how current the topic is. Christine Zott’s study shows exemplarily that the present legal framework does not meet all necessary constitutional requirements. She warns of an escape into dissemination of information by the state. The conclusions of this dissertation are of relevance for science, practice and the legislator.
