englischIn this interdisciplinary work, Max Wimmer shows that the use of algorithm-based decision-making systems (so-called ADM systems) can contribute to reducing discriminatory selection decisions in a lawful way. While human decision-making leads to discriminatory tendencies, ADM systems present the legally compliant opportunity to overcome such tendencies. In particular, the work addresses privacy concerns as well as objections that may arise due to the risk of technology-driven exclusion. At the same time, however, a need for action de lege ferenda for the enforcement of the existing law is identified and presented for further discusion.
