englischGerman labour law provides a number of statuary rights, which offer employees the possibility to change the number of working hours. These laws require employer and employee to negotiate on the reduction; if an agreement cannot be found, the employer is – under certain conditions – obliged to reduce the working hours. This book offers an analysis of these laws and shows their common dogmatic structure. It then puts the focus on renegotiation in general civil law. In this context it elaborates on the question, if a statuary right on a change of an existing contract does or does not include an obligation to enter a process of negotiation before being exercised in court.
