englischAccording to German law, a deed cannot be executed unless the notary reads the text to the parties aloud. If the agreement is extensive, this can be a time-consuming task. In practice, however, a welcome – and widely used – simplification is available by relegating the more intricate details to attachments which are then referred to in the main agreement. The author constructs different scenarios in order to determine under which circumstances schedules and exhibits must be referred to, and which simplifications apply in these cases. In particular, the author points to a potential clash of the statutory provision allowing reference to deeds executed with third parties for the sole purpose of referring to them in other instruments with the purpose of the requirement for execution before a notary. The thesis concludes with a reform proposal to remove the present possibilities for circumvention whilst extending the exemption from the duty to read documents aloud.
Zu den Erfordernissen der notariellen Beurkundung gehört die Vorlesungspflicht. Bei umfangreichen Vertragswerken ist dies oft ein mühsames Unterfangen. Für manche Anlagen gelten freilich Verfahrenserleichterungen, die in der Praxis rege genutzt werden. Die Autorin analysiert für verschiedene Fallkonstellationen, unter welchen Voraussetzungen eine Anlage zum Gegenstand der Urkunde gemacht werden muss. Der Rechtsanwender erfährt im Detail, welche Verfahrenserleichterungen bei der Verweisung auf Anlagen gelten. Mit Blick auf Bezugsurkunden legt die Autorin dar, dass die Verweisung auf mit Dritten zum bloßen Zwecke der Verfahrensverkürzung errichtete Urkunden zwar de lege lata zulässig, vor dem Hintergrund der mit der notariellen Beurkundung verfolgten Zwecke jedoch problematisch ist. Um insoweit einen Qualitätsgewinn zu erreichen, mündet die Arbeit in einem Vorschlag zur Reform des Beurkundungsgesetzes, der zugleich Umgehungsmöglichkeiten einschränkt und dem Ziel der Reduktion der Vorlesungspflicht Rechnung trägt.
