englischIt is necessary for the proper functioning of the internal market to determine the law applicable to the effects of insolvency proceedings on transactions with legal certainty. Based on a europe-wide uniform qualification method the work explores the law applicable to insolvency avoidance in accordance with Art. 7 II lit. m), 16 of the European Insolvency Regulation.
The work is based on a detailed investigation of the purpose of these provisions. On this basis, the scope of application is determined as well as the interpretation of the wording of Art. 16 of the European Insolvency Regulation “no means of challenging that act in the relevant case”.
Bei grenzüberschreitenden Geschäftsbeziehungen ist es für die Rechtspraxis grundlegend zu wissen, nach welcher Rechtsordnung sich der insolvenzrechtliche Bestand ihres Rechtsgeschäfts richtet. Die Arbeit beantwortet auf der Basis einer unionsrechts-autonomen Qualifikation die Frage, welche Rechtsordnung nach den geltenden Vorschriften der EuInsVO auf die Insolvenzanfechtung Anwendung findet.
Die Autorin untersucht die bisher in Literatur und Rechtsprechung vertretenen Ansätze und verdeutlicht, dass nur ein unionsrechts-autonomer, funktionaler Ansatz zielführend sein kann. Ausgehend von einer funktionalen Analyse der Art. 7 Abs. 2 lit. m), 16 EuInsVO wird die lex causae für unterschiedliche Konstellationen der Insolvenzanfechtung ermittelt. Daneben werden der Anwendungsbereich der Art. 7 Abs. 2 lit. m), 16 EuInsVO und der Umfang der Darlegungs- und Beweislast des Anfechtungsgegners untersucht.
