englischThe book examines the legal framework and technical boundaries of the customer’s right to remove software defects at the developer’s cost. Although the execution of software development projects is often problematic, the statutory right of self-execution is rarely used in a software development context. This is usually due to legal concerns or technical issues. Against this background, the author examines the tensions between the customer’s right of self-execution according to Section 637 German Civil Code and the developer’s copyright in the software according to Section 69a et sqq. German Copyright Act. The results may be relevant not only to the technical feasibility of the right of self-execution but also to the drafting of software development contracts.
