englischThe present study focusses on the German Council of Private International Law and its function as advisory body to the German Federal Ministry of Justice since 1953. Using the example of the 1986 reform concerning international matrimonial law and its further development, it analyses, for the first time, how the transfer of scientific knowledge to the political process works in this particular case. Therefore, the author assessed an extensive number of the Council’s files as well as unpublished sources from the Federal Archives and spoke to present members to achieve a legal and political qualification of the Committee. Part of the qualification was, not least, a comparison with the Council’s prototype, namely the Comité français de droit international privé.
Die vorliegende Arbeit widmet sich dem Deutschen Rat für Internationales Privatrecht und seiner Tätigkeit als Beratungsgremium des BMJV seit 1953. Sie ermittelt erstmals anhand des Fallbeispiels der Reform des internationalen Eherechts von 1986 und dessen weiterer Entwicklung, wie Wissenstransfer in den politischen Prozess in diesem Fall gelingt. Hierfür hat die Verfasserin den umfassenden Aktenbestand des Deutschen Rats für IPR sowie unveröffentlichte Quellen aus dem Bundesarchiv in Koblenz analysiert und auch auf Grundlage von Gesprächen mit Ratsmitgliedern eine rechtliche sowie politische Qualifikation des Gremiums vorgenommen. Teil dieser Qualifikation ist nicht zuletzt ein Vergleich zum Gründungsvorbild des Rats, namentlich dem französischen Comité français de droit international privé.
