englischEvery fifth attorney in Germany practices a second profession (e.g. notary, insolvency administrator, tax consultant). Since conflicts of interest can arise between the attorney's profession and the secondary profession, the BRAO (Federal Lawyers' Act) prohibits attorneys from practicing as an attorney if he or she has already been involved in the same matter in another profession (Section 45 (1) BRAO), as well as from acting as a secondary professional if he or she has already been involved as an attorney (Section 43a (6) BRAO). The dissertation analyses the scope, the purpose and the limits of the bans on professional practice under Sections 43a (6), 45 BRAO and deals with numerous secondary professions.
