englischUnconventional gas production in general and fracking in particular generate a great array of uncertainties. By generating knowledge, aspects of legal risk-management may enhance the otherwise challenging decision making process. Potential approaches to these uncertainties could be implementing instruments such as time limitation to legal regulations, obligatory evaluation and revision processes as well as a restriction on pilot projects. Regarding the issue from a constitutional law perspective, questions arise concerning the constitutional protection obligations as well as civil rights and liberties, but also principles of state law. Additional considerations also query whether and how existing constitutional requirements may take effect on legal aspects of risk-management.
