englischThis dissertation examines the practical question of who is entitled to claim in the case of a violation of Art. 101 and Art. 102 TFEU in the context of antitrust claims for damages and defense. It is first examined which dogmatic structure the claims have and which elements are to be assessed under primary law. This is followed by a functional analysis of Art. 101 and Art. 102 TFEU and the antitrust claims. In the main part, the eligibility of claims is then determined in the abstract by evaluating these functions. The effects of violations of European antitrust law are examined, which enables a typification of injured parties and a classification of case groups.
