englischThe book deals with liability issues regarding the use of hydraulic fracturing (fracking). After giving an overview on technical aspects, ongoing discussions regarding potential risks and the existing authorization framework, it focuses on an analysis of the relevant liability provisions (strict liability and liability for fault), as well as on compensation claims. One key aspect, which is examined within this scope is, whether and to what extend a strict liability for damages caused by frackings can be justified based on para 114 subseq. of the German Federal Mining Act ("BBergG"). Furthermore, it is examined whether a liability according to para 89 WHG, para 1 UmweltHG and para 823 German Civil Code ("BGB") can be justified.

The author is a lawyer in the Dusseldorf office of an international law firm. He advises and represents both national and international companies in all matters related to energy law.
