englischDoping continues to play a major role in sport. This also applies to legal disputes in connection with doping. In professional sport it is common practice to make athletes subject to sports arbitration. However, athletes often do not have a real choice between having doping disputes decided by a public court or by private (sports) arbitration. The author therefore addresses the question whether the current practice of dispute resolution in sports is still tenable or to what extent it violates the rights of the athletes. She then deals with the possibilities of reorganising the (national) sports dispute resolution while respecting the fundamental rights of the parties involved.
